Naples Police officer arrested for a DUI

A Naples police officer was arrested for a DUI and resisting an offcer on December 17, 2012. After being pulled over, officer Michael Little admitted to drinking a few beers. The deputy then called for backup and Little ran away on foot. The deputy, whom was a female, overpowered Little who appeared to be going to dig in his pocket. A .25 caliber beretta was later found in his pocket.

The amazing part of this story is how was it that Little was not charged with a felony fleeing and eluding or felony resisting an officer after going for his gun?
